3. General information and mandatory information

Data protection

The operators of this website and its pages take the protection of your personal data very seriously. Hence, we handle your personal data as confidential information and in compliance with the statutory data protection regulations and this Data Privacy Statement.

Whenever you use this website, a variety of personal information will be collected. Personal data comprises data that can be used to personally identify you. This Data Privacy Statement explains which data we collect as well as the purposes we use this data for. It also explains how, and for which purpose the information is collected.

We herewith advise you that the transmission of data via the Internet (i.e. through email communications) may be prone to security gaps. It is not possible to completely protect data against third party access.

Information about the responsible party (referred to as the “controller” in the GDPR)

The data processing controller on this website is:

Linguamon GmbH

Telephone: 0231/5575130
Email: info@linguamon.de

The controller is the natural person or legal entity that single-handedly or jointly with others makes decisions as to the purposes of and resources for the processing of personal data (e.g. names, email addresses, etc.).

Retention period

Unless a more specific storage period has been specified within this Data Privacy Statement, your personal data will remain with us until the purpose for the data processing no longer applies. If you assert a justified request for deletion or revoke your consent to data processing, your data will be deleted unless we have other legally permissible reasons for storing your personal data (e.g. retention periods under tax or commercial law); in the latter case, the data will be deleted after these reasons no longer apply.

Information on data transfer to the USA

Our website uses, in particular, tools from companies based in the USA. If these tools are active, your personal data may be transferred to the US servers of the corresponding companies. We would like to point out that the USA is not a safe third country in the sense of EU data protection law. Companies in the US are required to release personal data to security authorities without you as a data subject being able to take legal action against this. It can therefore not be ruled out that US authorities (e.g. intelligence services) process, evaluate, and permanently store your data located on US servers for monitoring purposes. We have no influence on these processing activities.

Revocation of your consent to data processing

Many data processing operations are only possible with your express consent. You can withdraw your consent at any time. This shall be without prejudice to the lawfulness of any data collection that occurred prior to your revocation.

Right to object to the collection of data in special cases; right to object to direct advertising (Art. 21 GDPR)

IN THE EVENT THAT DATA IS PROCESSED ON THE BASIS OF ART. 6(1)(E) OR(F) GDPR, YOU HAVE THE RIGHT TO AT ANY TIME OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA BASED ON GROUNDS ARISING FROM YOUR UNIQUE SITUATION. THIS ALSO APPLIES TO ANY PROFILING BASED ON THESE PROVISIONS. TO DETERMINE THE LEGAL BASIS ON WHICH ANY PROCESSING OF DATA IS BASED, PLEASE CONSULT THIS DATA PRIVACY STATEMENT. IF YOU OBJECT, WE WILL NO LONGER PROCESS PERSONAL DATA CONCERNING YOU UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, RIGHTS, AND FREEDOMS, OR IF THE PROCESSING SERVES THE PURPOSE OF ASSERTING, EXERCISING, OR DEFENDING LEGAL CLAIMS (OBJECTION PURSUANT TO ARTICLE 21(1) GDPR).

IF YOUR PERSONAL DATA IS BEING PROCESSED FOR THE PURPOSE OF DIRECT MARKETING, YOU HAVE THE RIGHT TO AT ANY TIME OBJECT TO THE PROCESSING OF PERSONAL DATA FOR THE PURPOSE OF SUCH MARKETING. THIS ALSO APPLIES TO PROFILING TO THE EXTENT THAT IT IS AFFILIATED WITH SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR THE PURPOSE OF DIRECT MARKETING (OBJECTION PURSUANT TO ART. 21(2) GDPR).

Right to log a complaint with the competent supervisory agency

In the event of violations of the GDPR, data subjects are entitled to log a complaint with a supervisory agency, in particular in the member state where they usually maintain their domicile, their place of work, or at the place where the alleged violation occurred. The right to log a complaint is in effect regardless of any other administrative or court proceedings available as legal recourses.

Right to data portability

You have the right to demand that any data we automatically process on the basis of your consent or in order to fulfill a contract be handed over to you or a third party in a commonly used, machine readable format. If you should demand the direct transfer of the data to another controller, this will be done only if it is technically feasible.

SSL and/or TLS encryption

This site uses SSL or TLS encryption for security reasons and to protect the transmission of confidential content such as orders or requests that you submit to us as the site operator. You can recognize an encrypted connection by checking whether the address line of the browser switches from “http://” to “https://” and also by the appearance of the lock icon in the browser line.

If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

Information, deletion, and correction

Within the scope of the applicable statutory provisions, you have the right to receive information about your archived personal data, their source and recipients, and the purposes of the processing of your personal data at any time without having to pay a fee for such disclosures. You also have the right to demand that your data is rectified or eradicated. You can contact us at any time with regard to this and other questions on the subject of personal data.

Right to restriction of processing

You have the right to demand the imposition of restrictions as far as the processing of your personal data is concerned. For this purpose, you can contact us at any time. The right to demand restriction of processing exists in the following cases:

  • In the event that you should dispute the correctness of your personal data archived by us, we will usually need some time to verify this claim. During the time that this investigation is ongoing, you have the right to demand that we restrict the processing of your personal data.
  • If the processing of your personal data was/is conducted in an unlawful manner, you have the option to demand the restriction of the processing of your data in lieu of demanding the eradication of this data.
  • If we do not need your personal data any longer and you need it to exercise, defend, or claim legal entitlements, you have the right to demand the restriction of the processing of your personal data instead of its eradication.
  • If you have raised an objection pursuant to Art. 21(1) GDPR, your rights and our rights will have to be weighed against each other. As long as it has not been determined whose interests prevail, you have the right to demand the restriction of the processing of your personal data.

If you have restricted the processing of your personal data, this data – with the exception of their archiving – may be processed only subject to your consent or to claim, exercise or defend legal entitlements or to protect the rights of other natural persons or legal entities or for important public interest reasons cited by the European Union or a member state of the EU.

In some instances, our website and its pages use so-called cookies. Cookies are small text files and do not cause any damage to your end device. They are either stored temporarily for the duration of a session (session cookies) or permanently (permanent cookies) on your end device. Session cookies are automatically deleted at the end of your visit. Permanent cookies remain stored on your end device until you delete them yourself or until they are automatically deleted by your web browser.

In some cases, cookies from third-party companies may also be stored on your end device when you enter our site (third-party cookies). These enable us or you to use certain services of the third-party company (e.g. cookies for processing payment services).

Cookies have various functions. Many cookies are technically necessary, as certain website functions would not work without them (e.g. the shopping cart function or the display of videos). Other cookies are used to evaluate user behavior or to display advertising.

Cookies that are necessary to carry out the electronic communication process (necessary cookies) or to provide certain functions that you have requested (functional cookies, e.g. for the shopping cart function) or to optimize the website (e.g. cookies to measure the web audience) are stored on the basis of Art. 6(1)(f) GDPR, unless another legal basis is specified. The website operator has a legitimate interest in storing cookies to ensure the technically error-free and optimized provision of its services. Insofar as consent to the storage of cookies has been requested, the storage of the cookies in question is based exclusively on this consent (Art. 6(1)(a) GDPR); consent can be revoked at any time.

You can set up your browser in such a manner that you are informed anytime cookies are set and only allow cookies in certain cases, exclude the acceptance of cookies in certain cases or in general, and you can also activate the automatic deletion of cookies when closing of the browser. If you deactivate cookies, the functionality of this website may be limited.

Insofar as cookies are used by third-party companies or for analysis purposes, we will inform you separately within the framework of this Data Privacy Statement and, if necessary, request your consent.

If you submit inquiries to us via our contact form, the information provided in the contact form as well as any contact information provided therein will be stored by us in order to handle your inquiry and in the event that we have further questions. We will not share this data without your consent.

The processing of this data is based on Art. 6(1)(b) GDPR, if your request is related to the execution of a contract or if it is necessary to carry out pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective processing of the requests addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR) if this has been requested.

The information you have entered into the contact form shall remain with us until you ask us to eradicate the data, revoke your consent to the archiving of data, or if the purpose for which the information is being archived no longer exists (e.g. after we have concluded our response to your inquiry). Mandatory statutory provisions – in particular retention periods – remain unaffected.

Request by email, telephone, or fax

If you contact us by email, telephone, or fax, your request, including all resulting personal data (name, request) will be stored and processed by us for the purpose of processing your request. We will not share this data without your consent.

The data sent by you to us via contact requests shall remain with us until you ask us to eradicate the data, revoke your consent to the archiving of data, or if the purpose for which the data is being archived no longer exists (e.g. after processing your request is complete). Mandatory legal provisions – in particular legal retention periods – remain unaffected..

5. Analytics and advertising

Google Analytics

This website uses functions of the web analysis service Google Analytics. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Analytics enables the website operator to analyze the behavior patterns of website visitors. In doing so, the website operator receives a variety of usage data, such as such as page views, length of stay, operating systems used, and the origin of the user. This data may be summarized by Google in a profile that is assigned to the respective user or their end device.

Google Analytics uses technologies that enable the recognition of the user for the purpose of analyzing user behavior (e.g. cookies or device fingerprinting). The information collected by Google about the use of this website is usually transferred to a Google server in the USA and stored there.

The use of this analysis tool is based on Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the analysis of user patterns in order to optimize the operator’s web offerings and advertising. If appropriate consent has been obtained (e.g. consent to store cookies), the processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR. This consent can be revoked at any time.

Data transmission to the US is based on the Standard Contractual Clauses (SCC) of the European Commission. Details can be found here: https://business.safety.google/adscontrollerterms/sccs/

IP anonymization

We have activated the IP anonymization function on this website. As a result, your IP address will be shortened by Google within the Member States of the European Union or in other states that have ratified the Convention on the European Economic Area prior to its transmission to the United States. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators, and providing other services relating to website activity and internet usage. The IP address transmitted by your browser as part of the Google Analytics service will not be combined with any other data held by Google.

Browser plug-in

You can prevent the collection and processing of your data by Google by downloading and installing the browser plug-in available at the following link: https://tools.google.com/dlpage/gaoptout?hl=en.

For more information about the handling of user data by Google Analytics, please consult Google’s privacy policy at: https://support.google.com/analytics/answer/6004245?hl=en.

Contract data processing

We have concluded a contract data processing agreement with Google and fully implement the strict regulations of the German data protection authorities when using Google Analytics.

Demographic parameters provided by Google Analytics

This website uses the “demographic characteristics” function of Google Analytics to be able to display compatible advertisements to website visitors within the Google advertising network. It makes it possible to generate reports providing information on the age, gender, and interests of website visitors. The sources of this information are interest-related advertising by Google as well as visitor data obtained from third party providers. This data cannot be allocated to a specific individual. You have the option to deactivate this function at any time by making pertinent settings changes for advertising in your Google account, or you can generally prohibit the recording of your data by Google Analytics as explained in section “Objection to the recording of data”.

Google Analytics e-commerce tracking

This website uses the “e-commerce tracking” function of Google Analytics. With the help of e-commerce tracking, the website operator is in a position to analyze the purchasing patterns of website visitors with the aim of improving the operator’s online marketing campaigns. In this context, information such as the orders placed, the average order values, shipping costs, and the time from viewing the product to making a purchasing decision are tracked. This data may be consolidated by Google under a transaction ID, which is assigned to the respective user or the user’s device.

Storage duration

Data on the user or event level stored by Google and linked to cookies, user IDs, or advertising IDs (e.g. DoubleClick cookies, Android Advertising ID) will be anonymized or deleted after 14 months. For details, please click on the following link: https://support.google.com/analytics/answer/7667196?hl=en

Google Ads

The website operator uses Google Ads. Google Ads is an online advertising program of Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Ads allows us to display advertisements in the Google search engine or on third-party websites when a user enters certain search terms on Google (keyword targeting). In addition, targeted advertisements can be displayed on the basis of user data (e.g. location data and interests) available at Google (target group targeting). As a website operator, we can evaluate this data quantitatively by analyzing, for example, which search terms have led to the display of our advertisements and how many advertisements have led to corresponding clicks.

The use of Google Ads is based on Art. 6(1)(f) GDPR. The website operator has a legitimate interest in marketing its service products as effectively as possible.

Data transmission to the US is based on the Standard Contractual Clauses (SCC) of the European Commission. Details can be found here: https://policies.google.com/privacy/frameworks and https://privacy.google.com/businesses/controllerterms/mccs/.

6. Plug-ins and tools

YouTube with extended data protection

This website embeds videos from YouTube. YouTube is operated by Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

We use YouTube in the privacy-enhanced mode. According to YouTube, this mode ensures that YouTube does not store any information about visitors to this website before they watch the video. However, the privacy-enhanced mode does not exclude the possibility that your data will be passed to YouTube partners. For instance, regardless of whether you are watching a video, YouTube will always establish a connection to the Google DoubleClick network.

As soon as you start a YouTube video on this website, a connection to the YouTube servers is established. In this case, the YouTube server will be notified which of our pages you have visited. If you are logged into your YouTube account while visiting our site, you enable YouTube to assign your browsing patterns directly to your personal profile. You can prevent this by logging out of your YouTube account.

In addition, YouTube may store various cookies on your end device or use comparable recognition technologies (e.g. device fingerprinting) after you start a video. In this manner, YouTube can obtain information about visitors to this website. Among other things, this information will be used to generate video statistics with the aim of improving user friendliness and preventing attempts to commit fraud.

Under certain circumstances, additional data processing transactions may be triggered after you have started to play a YouTube video, which are beyond our control.

The use of YouTube is based on our interest in presenting our online content in an appealing manner. Pursuant to Art. 6(1)(f) GDPR, this is a legitimate interest. If appropriate consent has been obtained, the processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR. This consent can be revoked at any time.

For more information on how YouTube handles user data, please consult the YouTube Privacy Policy at: https://policies.google.com/privacy?hl=en.

This website uses so-called Web Fonts provided by Google to ensure the uniform use of fonts on this site. When you access a page, your browser loads the required web fonts into your browser cache in order to display text and fonts correctly.

For this purpose, the browser you are using must connect to Google’s servers. This is how Google receives the information that our website has been accessed via your IP address. The use of Google WebFonts is based on Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the uniform presentation of the typeface on its website. If appropriate consent has been obtained (e.g. consent to store cookies), the processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR. This consent can be revoked at any time.

If your browser does not support web fonts, a standard font will be used by your computer.

For more information on Google Web Fonts, see  https://developers.google.com/fonts/faq and in the privacy policy of Google: https://policies.google.com/privacy?hl=en.

Font Awesome

This site uses Font Awesome for the uniform display of fonts and symbols. The provider is Fonticons, Inc, 6 Porter Road Apartment 3R, Cambridge, Massachusetts, USA.

When you access a page, your browser loads the required fonts into your browser cache in order to display text, fonts, and symbols correctly. For this purpose, the browser you are using must connect to Font Awesome’s servers. This allows Font Awesome to receive information that our website has been accessed via your IP address. The use of Font Awesome is based on Art. 6(1)(f) GDPR. We have a legitimate interest in the uniform presentation of the typeface on our website. If appropriate consent has been obtained (e.g. consent to store cookies), the processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR. This consent can be revoked at any time.

If your browser does not support Font Awesome, a standard font will be used by your computer.

Google reCAPTCHA

We use “Google reCAPTCHA” (hereinafter “reCAPTCHA”) on this website. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

The purpose of reCAPTCHA is to check whether the data entered on this website (e.g. in a contact form) has been entered by a human or by an automated program. To do this, reCAPTCHA analyzes the behavior of the website visitor based on various characteristics. This analysis starts automatically as soon as the website visitor enters the website. For the analysis, reCAPTCHA evaluates various information (e.g. IP address, the time spent by the website visitor on the website, or cursor movements initiated by the user).  The data collected during the analyses is forwarded to Google.

The reCAPTCHA analyses run completely in the background. Website visitors are not alerted that such an analysis is taking place.

The data is stored and analyzed based on Art. 6(1)(f) GDPR. The website operator has a legitimate interest in protecting its website from abusive automated spying and SPAM. If appropriate consent has been obtained, the processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR. This consent can be revoked at any time.
